The probe of possible influence-peddling at CalPERS and other public pension funds has become a criminal investigation, the Wall Street Journal is reporting.
Quoting unnamed sources, the newspaper said Friday that U.S. Justice Department investigators inLos Angeles are examining whether investment decisions at CalPERS and other funds were influenced by illegal payments.
The paper said the probe includes the activities of placement agents, middlemen hired by private equity firms to obtain investments from CalPERS and other public funds.
Six people have pleaded guilty to criminal charges involving New York state's public pension system, but no criminal case has been filed in connection with any California funds.
However, California private equity firms and placement agents who have done business at CalPERS are among those who have pleaded guilty or made civil settlements in the New York investigation.
Brad Pacheco, a spokesman for the California Public Employees' Retirement System, said the fund hasn't been contacted by criminal investigators. He said CalPERS continues to cooperate with investigators from the Securities and Exchange Commission, which is conducting a noncriminal investigation.
The California State Teachers' Retirement System, which has also done business with firms that have used placement agents, isn't aware of any criminal investigation, either, said spokesman Ricardo Duran.
Thom Mrozek, a spokesman for the U.S. attorney's office in Los Angeles, declined comment.
Questions about the activities of placement agents vying for CalPERS investments mushroomed after the fund disclosed last fall that one agent, Alfred Villalobos – a fund board member until 1995 – had pocketed almost $60 million in commissions from CalPERS deals.
Villalobos couldn't be reached for comment Friday.
All told, the 10 most prolific placement agents have earned $125 million from CalPERS deals.
The revelations prompted CalPERS to hire a Washington law firm to investigate placement agent activities. The pension fund also rallied around legislation that would ban commission payments and require agents to register as lobbyists. The legislation is pending.
One of those pleading guilty in the New York corruption case – Los Angeles financier Elliott Broidy – has also had dealings with CalPERS. Broidy admitted in December that he paid $1 million to New York state officials to obtain pension fund investments.

State senator and GOP governor hopeful Paula Dockery blasted Republican operative Michael Caputo for linking her with Orlando politico Doug Guetzloe, the center of a Tea Party turf battle playing out in federal court.
Guetzloe joined forces with Dockery in fighting the SunRail/CSX deal during the special legislative session and has supported her candidacy against Attorney General Bill McCollum in the Republican primary for governor.
Caputo, a Republican operative who has worked on campaigns in and out of the U.S. and who is closely linked with Roger Stone, and a variety of local Tea Party groups filed a lawsuit against Guetzloe and his cohorts accusing them of hijacking the “real” Tea Party and asking the court to order him to stop using the “Tea Party” moniker.

Planned Switch to G.O.P. Stirs Governor’s Race in New York

ALBANY — A governor’s race that seemed all but settled could soon be upended again, by a popular Democrat from Long Island who is planning to switch parties, a move certain to excite Republican leaders pessimistic about their party’s hopes this fall.
Those leaders believe that the official, Steve Levy, a blunt-spoken fiscal hawk and contrarian who collected 96 percent of the vote in his last re-election bid, can tap into the public’s anti-incumbent sentiment and frustration with Albany’s overspending.
Mr. Levy, 50, the Suffolk County executive, said he wanted voters to see him as “Scott Brown II,” referring to the Massachusetts senator who pulled off an upset against a heavily favored Democrat in January.
“There really seems to be a void out there that I can fit perfectly,” Mr. Levy said, describing Albany’s political culture as a “cesspool.”

I would love to see someone like Mark W. Smith the author of The Official Handbook of the Vast Right Wing Conspiracy: The Arguments you need to defeat the Loony Left, he is also a former professor of Law, and regularly appears in the national media as a political and legal commentator run for US Senate against either "King" Breakfast, Lunch & Dinner Schumer or "Queen" Et Tu Gillibrand.
Now that would be a race and in the end Mr Smith would go to Washington.
